The Get Hands On Follow the Leader Service Challenge

OFFICIAL RULES

The following rules (the "Official Rules") apply to the Get HandsOn Follow the Leader Service Challenge (the "Challenge") offered via the Get HandsOn ("GHO") campaign website located at www.gethandson.com (the "Website"). The Challenge is an initiative that aims to inspire people to make a commitment to carry out one of several exemplary service projects or activities listed on the Website, and to reward them for having done so. Points of Light Institute is the sponsor of the Challenge ("Sponsor").

For purposes of the Challenge, committing to a project consists of clicking on the virtual button next to the name and description of the project on the Website.  A project will be deemed to have been completed when a member has (i) actually completed the work required by / constituting the project, and (ii) completed a journal entry on the project (including submitting at least one photo and/or video of the project. 

1. Eligibility

In order to enter and compete in the Challenge, you must be registered as a  member of the GHO campaign community ("Member").  To become a Member, visit the Website and register as directed by the online instructions available at the Website.

NO PURCHASE, DONATION OR SUBSTANTIAL EFFORT NECESSARY TO PARTICIPATE IN THE CHALLENGE. ENTRY INTO THE CHALLENGE OPEN ONLY TO MEMBERS WHO ARE LEGAL RESIDENTS OF ONE OF THE 50 UNITED STATES, THE DISTRICT OF COLUMBIA OR PUERTO RICO AND 13 YEARS OF AGE OR OLDER AS OF THE DATE OF ENTRY.  VOID WHERE PROHIBITED.

EMPLOYEES OF SPONSOR, ANY AFFILIATED PARTY (AS DEFINED HEREIN BELOW), AND ANY ADVERTISING/PROMOTIONAL AGENCIES AND/OR OTHER CONSULTANTS, AGENTS AND REPRESENTATIVES INVOLVED WITH THE CHALLENGE, AND THE IMMEDIATE FAMILIES AND HOUSEHOLD MEMBERS OF SUCH EMPLOYEES, ARE INELIGIBLE TO ENTER OR WIN IN THE CHALLENGE. 

2. Challenge Period

The Challenge begins at 12:00:01 AM EDT on January 18, 2011, and ends at 11:59:59 PM EDT on May 31, 2022 (the "Challenge Period").  All commitments to projects must be made and projects must be completed during the Challenge Period as required by these rules. Any attempts to commit to or report a project as completed that are late, misdirected, incorrect or incompletely received for any reason, including by reason of hardware, software, browser or network failure, malfunction, congestion or incompatibility at Sponsor's servers or elsewhere will not be eligible. 

3. Prize Categories

There will be two (2) prize categories for the Challenge, with prizes totaling more than $15,000 in value.

The prizes to be awarded in connection with the Challenge will consist of the following:

  1. One (1) prize in a category designated the "Follow the Leader Grand Prize Award" totaling more than $3,500 in value, and
  2. five (5) prizes in a category designated the "Follow the Leader Monthly Prize Awards" totaling more than $11,500 in value.

The prizes described in Paragraphs (a) and (b) above are referred to collectively herein as "Awards").  All prizes will be awarded.  If for any reason a winner becomes ineligible or does not comply with the requirements for verification of winners as outlined in Section 7 below (Award Winner Verification), another winner will be selected at random from the eligible members. 

4. Awarding The Prizes

The prizes available in the various categories described above will be awarded to the respective winning Members themselves and, where applicable, to the respective Qualifying Charities of choice designated by the respective winning Members on behalf of the respective winning Members as provided herein below; provided that, to be eligible to receive this portion of an Award, the charity designated by the Winning Member must be registered as a 501(c)(3) organization (under the United States Internal Revenue Code) and  listed in the Guidestar database available at www.guidestar.org (any charity so registered and listed is referred to herein as a "Qualifying Charity".

Follow the Leader Grand  Prize Award.  All Members who commit to and complete a project during the Challenge Period will be eligible to win the Leader Grand Prize Award.  The Grand Prize will consist of an all expense paid trip for two to the Philippines for a one week "Volunteer Vacation" coordinated by HandsOn Manila, that includes airfare, fees, six night's lodging, and all internal transfers.

The winner will be randomly selected on June 6th from among all eligible Members.    

Follow the Leader Monthly Awards.  All Members who committed to a project between 12:00:01 AM EDT on January 18th and 11:59:59 PM EDT on January 31, 2022 will be eligible to compete for/win the Monthly Awards for the month in which the commitment was made. All Members who completed a project (as defined above) between 12:00:01 AM EDT on the first day of each of February, March, April and May, 2011, and 11:59:59 PM (EDT or EST as appropriate) on the last day of each of said months will be eligible to compete for/win the Monthly Awards for the month in which the project was completed. The Monthly Awards winners will be randomly selected in a drawing from among all Members eligible to participate in the drawing being conducted for the month in question. Selections will be made on the first day of the month following the month for which the drawing is being conducted. Although Members can commit to/complete as many projects as they desire, each eligible Member will receive only one entry per month into the virtual drawing. (The winning Member will be selected at random by computer from all of the eligible Members.) The Monthly Awards will consist of the following: 

  1. January:  iPad for Member and $2,500 grant for his/her Qualifying Charity;
  2. February: An all expense paid trip for two to Washington, D.C.  and two tickets to the POLI Tribute event in March that includes airfare, one night's lodging, and ground transportation to and from the event;
  3. March:  All expense paid trip for two to the annual National  Conference on Volunteering and Service to be held in New Orleans, LA, from June 6-8, 2011 that includes three night's lodging, registration for the Conference, and ground transportation;
  4. April:  iPad for Member and $2,500 grant for his/her Qualifying Charity; and
  5. May:  All expense paid trip for two to a taping of an episode of HGTV's "Curb Appeal: The Block with John Gidding" (location to be determined) that includes one night's lodging and ground transportation.

Prizes of approximately equivalent cash value may be awarded at the sole discretion of Sponsor.

The winners of Awards will be announced by Sponsor within approximately 30 days after the end of the Challenge Period.  The winners will be contacted using the information provided via the Website.  All Members agree that the Awards and division of Awards will be decided by Sponsor, in its sole and absolute discretion, and that any and all decisions are final.  All applicable taxes on prizes are the sole responsibility of the winner.  Awards won by any Member  under the age of majority shall only be awarded/delivered to such winning Member's parent or other legal guardian.  Non-cash prizes may not be substituted, transferred or redeemed for cash.  

5. Award Winner Verification

To be eligible to receive the particular Award involved, each Award-winning Member and his/her Qualifying Charity of choice (if applicable) must, upon request of Sponsor, sign and return the following documents: 

  1. An affidavit of eligibility and release, together with any other release and/or waiver reasonably requested by Sponsor, releasing, in each instance, Sponsor and its respective officers, directors, employees, agents, members, subsidiaries, licensors, marketing partners, suppliers and other services providers, successors, assigns and any other party involved with the Challenge on behalf of Sponsor (said parties are referred to collectively herein as the "Affiliated Parties") from any and all liability, loss, claims, demands and causes of action for personal injury and/or damage, theft, loss or any other harm suffered in connection with the Challenge (including the use/misuse or acceptance of any Award, or any portion thereof); and 
  2. except where prohibited by law, a promotional release granting Sponsor and its designess any of the Affiliated Parties designated by Sponsor the right to use their name, likeness and other materials and information for advertising, research, marketing and publicity purposes without additional compensation or consent. 

Entry into the Challenge constitutes agreement by each Member to sign and promptly return all such documentation as may be requested by Sponsor before receiving a prize.

6. Entry Conditions

By entering in the Challenge, each Member agrees: 

  1. to be bound by and comply with (i) these Official Rules, (ii) any other rules or restrictions applicable to the Challenge and made available on the Website in connection with the Get HandsOn campaign, (iii) interpretations of these Official Rules by Sponsor and, (iv) decisions of Sponsor, which are final in all matters relating to the Challenge;
  2. not to hold him/herself out as an agent or representative of Sponsor;
  3. to release and hold harmless Sponsor and the Affiliated Parties from and against any and all claims, injury or damage arising out of, in connection with or relating to participation in the Challenge, and from any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other personal, proprietary or property rights of any party or any other intellectual property-related cause of action; and
  4. to acknowledge compliance with these Official Rules.

7. Postings; License Rights

  1. In order to promote, market and publicize the Challenge, Sponsor and certain other related initiatives, entities and services, Sponsor and the Affiliated Parties require a license to use any and all information, materials and content posted, made available or submitted in connection with each Member's participation in the Challenge, including, without limitation, each Member's and his/her designated Qualifying Charity's names (and likenesses), user name, biographical information, commitment and any other personal information (collectively, "Postings"). By way of example and by no means limitation, the Postings may be used in connection with leader boards, widgets, participant lists, news feeds, emails, notifications, message boards, forums, blogs, online social community network profiles/groups, periodicals, magazines, news reports, websites, programming channels, broadcast and other means of public display and performance, and other uses that may incorporate Sponsor's and/or the Affiliated Parties' property and branding (including, without limitation, promotional materials such as banners, photos, logos, trademarks, audio-visual content, widgets, etc.) (collectively, the "Presenter Materials"). 
  2. Accordingly, each Member hereby expressly (i) grants Sponsor and the Affiliated Parties a worldwide, perpetual, irrevocable, royalty-free, fully-paid, non-exclusive, sublicensable and transferable right and license to use, reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, exhibit, create derivative works, modify and promote any and all Postings in, on, through and in connection with any and all now known or hereafter devised, discovered or developed forms of media, products, platforms and services, without notice and without compensation, right of inspection, royalty, accounting, liability or obligation of any kind to any Member or any Qualifying Charity or other third party, and (ii) covenants, warrants, represents and agrees that such use will not give rise to any claims for infringement, invasion of privacy or publicity, or claims for any payment whatsoever, including but not limited to, claims for re-use fees or residuals. 

8. Postings Restrictions

  1. All contents of the Postings, with the exception of any incorporated Presenter Materials, including, without limitation, all graphical, audio-visual elements, imagery and artwork appearing in the Postings, must (i) be completely original to each Member, (ii) not have been taken or composed in whole or in part from any other source, and (iii) be free and clear of any liens or claims with respect to the use of the Postings.
  2. All Members agree that any and all Postings made during the Challenge Period or in connection with the Challenge shall not contain, include or involve (or be posted on any website(s) highlighting or featuring) any of the following: 

9. General Terms 

Any violation of these Official Rules may result in disqualification.  Sponsor reserve the right to reject any entries in the Challenge or any Member whose activities may be deemed, in its sole discretion, to violate these Official Rules, HandsOn Network's Terms of Use or Privacy Policy (which are available at http://handsonnetwork.org/terms and http://handsonnetwork.org/privacypolicy, respectively), and/or any other policies or guidelines established by Sponsor to govern participation and/or activities in connection with the Challenge and provided on the Website.

ANY VIOLATION OF THESE OFFICIAL RULES BY A MEMBER OR ANY BEHAVIOR BY A MEMBER THAT WILL BRING SUCH MEMBER OR SPONSOR INTO DISREPUTE (AS DETERMINED IN SPONSOR' SOLE AND ABSOLUTE DISCRETION) WILL RESULT IN SUCH MEMBER 'S DISQUALIFICATION AS AN AWARD WINNER FOR THE CHALLENGE AND ALL PRIVILEGES AS AN AWARD WINNER WILL BE IMMEDIATELY TERMINATED.

SPONSOR RESERVES THE RIGHT, IN ITS SOLE AND ABSOLUTE DISCRETION, AT ANY TIME, TO DISQUALIFY ANY QUALIFYING CHARITY DESIGNATED BY A MEMBER THAT SUPPORTS, PROMOTES OR CONDONES (DIRECTLY OR INDIRECTLY/IMPLICITLY OR EXPLICITLY) VIOLENCE, DISCRIMINATION (WHETHER BASED ON SEX, RELIGION, RACE, ETHNICITY, NATIONALITY, DISABILITY, AGE OR OTHERWISE), HATRED, ILLEGAL ACTIVITIES OR ANY OTHER ACTIVITY, BEHAVIOR OR CONDUCT THAT IS OBJECTIONABLE, INAPPROPRIATE, UNSUITABLE, OFFENSIVE OR THREATENING.

Further, Sponsor reserves the right to (a) modify these Official Rules at any time during the Challenge Period and (b) cancel, terminate or modify any transmission or other activity not capable of completion as planned, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, force majeure or technical failures of any sort. Sponsor is not responsible for errors in the administration or fulfillment of the Challenge, including, without limitation, mechanical, human, printing, distribution or production errors, and may modify or cancel the Challenge based upon such error at their sole discretion without liability. Sponsor assumes no responsibility for the incorrect or inaccurate posting of information (whether caused by any of the equipment or programming associated with or utilized in the Challenge or by any human error that may occur in the processing of the Postings in the Challenge. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or players on account of technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including, without limitation, any injury or damage to a Member's or any other person's computer related to or resulting from participation in or downloading any materials (including, without limitation, the Presenter Materials) for the Challenge.  Sponsor is not responsible for any typographical or other error in the printing of any materials, administration of the Challenge, or in the announcement of the Awards or Award winners. If, for any reason, a particular Member and/or his/her Qualifying Charity of choice is not capable of being awarded an Award as planned, including, without limitation, due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, ineligibility or any other cause beyond the control of Sponsor that corrupts or affects the administration, security, fairness, integrity or proper conduct of the Challenge, Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the Challenge.  All interpretations of these Official Rules and decisions by Sponsor are final.  No software-generated, robotic, programmed, script, macro or other automated online or text message entries are permitted and will result in disqualification of all such entries.  Sponsor reserve the right in their sole discretion to disqualify any Member or other party it finds to (i) have tampered with the entry process or the operation of the Challenge; (ii) to be acting in violation of the Official Rules or the spirit of the Challenge; or (iii) to be acting in a disruptive manner, or with intent to annoy, abuse, threaten or harass any Member or other person, or to have provided inaccurate information at any time during the Challenge, including, without limitation, on any legal documents submitted in connection with the Challenge or otherwise.

CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CHALLENGE IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. 

Each Member and his/her designated Qualifying Charity hereby agree or shall, as a condition of receiving an Award, agree to (y) indemnify and hold harmless Sponsor and the Affiliated Parties from any and all liability resulting or arising from the Member's and/or his/her designated Qualifying Charity's acts or omissions in connection with the Challenge, including, without limitation, any Postings, and (z) release all rights to bring any claim, action or proceeding against Sponsor and the Affiliated Parties for any and all liability resulting or arising from the Challenge and hereby acknowledge that Sponsor and the Affiliated Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Awards or the Challenge. 

10. Applicable Laws And Jurisdiction

This Challenge is subject to all applicable federal, state and local laws and regulations. Issues concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by the laws of the State of Georgia.  All disputes arising out of or connected with the Challenge will be resolved individually, and without resort to class action, exclusively by a state or federal court located in Georgia.  Should there be a conflict between the laws of the State of Georgia and any other laws, the conflict will be resolved in favor of the laws of the State of Georgia.  All judgments or awards shall be limited to actual out-of-pocket damages (excluding attorneys' fees) associated with participation in the Challenge and shall not include any indirect, punitive, incidental and/or consequential damages. Each Member waives any and all objections to jurisdiction and venue in these courts and hereby submits to the jurisdiction of those courts. 

11. Official Rules/Award Winners Requests

For a copy of the Official Rules or the names of the Award winners, send a separate, stamped, self-addressed envelope to: Points of Light Institute, Get HandsOn Follow the Leader Service Challenge Terms/Winner Request, 600 Means Street NW,  Suite 210, Atlanta, GA 30318. Vermont residents may omit the return postage. Requests received after February 1, 2022 shall not be honored.
